WAIVER AND RELEASE I acknowledge that activities conducted at the Weld County Fish and Wildlife Association (hereinafter referred to as the “Club”) are inherently dangerous and that participation in such activities exposes me to a substantial and serious risk of personal injury, property damage or death. In consideration of being granted a membership in the Club, the right to use the Club and any of its facilities and the services provided by the Club, for myself and my spouse, legal representatives, heirs, successors and assigns, I do hereby waive, release and discharge the Club and its directors, officers and members (hereinafter referred to as “Released Parties”) from all liability to me and my spouse, legal representatives, heirs, successors and assigns, for any and all claims, suits, demands, loss or damage, including, without limitation, reasonable attorneys fees, arising out of or relating to my use of, or presence at, the Club or any of its facilities, on account of injury to me, even injury resulting in my death, or my property when caused by the negligence of one or more of the Released Parties or caused otherwise. As further consideration, I hereby waive any and all right I have, now or in the future, whether directly or indirectly, to commence or prosecute any action, suit or other proceeding against any or all of the Released Parties arising out of or related to my use of the Club or any of its facilities. As further consideration, I hereby agree to defend and indemnify the Released Parties and hold the Released Parties harmless from any liability, suit, claim, demand, cause of action, loss or damage, including, without limitation, reasonable attorney’s fees and costs incurred by any Released Party, arising from or related to my use of the Club or its facilities, any breach by me of any covenant or obligation of mine hereunder, or the use of, or presence at, the Club by my guest, including, without limitation, a member of my immediate family. I agree that the provisions of this Waiver and Release shall be binding upon me and my spouse, legal representatives, heirs, successors and assigns.
